here's just a small example of the frequently asked questions

  • I have heard of an enduring POA - is there a difference?
  • Does [freezing assets] have the same outcome if you have a joint bank account?
  • My dad has a joint life insurance policy with his estranged wife: it pays out on whoever passes first so how do I ensure if my dad passes first his funeral will be paid for out of the insurance money (I have an LPA)?
  • I have financially separated from my spouse, all drawn up by a solicitor and registered. We are still married; is he still entitled to automatically inherit my estate rather than the children?
  • My parents have revised their will so that instead of just splitting it between their 4 daughters, they have split it 5 ways with the 5th share being for grandchildren.
  • My sisters have all provided grandchildren, but I have not. presumably, I cannot argue that the money should go to just the daughters.
  • I co-own a house with my partner and we both have a mortgage on it, but I put in a large deposit from the sale of a previous home.
  • I want the house to go to my partner if I die but my half and the extra, I put in to go to my daughters if my partner married again?
  • Would social services regard putting your assets into a trust as deprivation if you needed social care in your old age?
  • Without a will who would a share of the house go to if you are not married? Would it go to your children of parents/siblings?
  • Is there any need to update an EPA to an LPA?
  • We are not married, but live together, the house is in my name. We do not have any Will or LPA. No children. What will happen to the house if I die first?
  • If children are under 18 in an unmarried partnership, would the other parent take control for them?
  • Can children under 18 be nominated as Executors for when they are old enough?
  • What is the pre-marital clause you mentioned that would go into the will to ensure the wills stand when you marry?
